Welcome to Spur Fitness ("Spur," "we," "us," or "our"), operated by Spur App LLC. By accessing or using our website, mobile application, or services (collectively, the "Service"), you agree to be bound by these Terms & Conditions ("Terms").

If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use Spur Fitness.

2. Health & Medical Disclaimer (CRITICAL)

Spur Fitness provides fitness, wellness, and nutrition content for educational and informational purposes only.

  • Spur is not a medical provider
  • We do not provide medical advice, diagnosis, or treatment
  • Always consult a physician before starting any exercise or nutrition program
  • You assume all risk for injuries, health conditions, or outcomes

By using Spur, you agree that you are solely responsible for your health and safety.

3. AI Features Disclaimer

Spur may provide AI-powered recommendations, coaching, or insights.

  • AI outputs are not medical advice
  • AI may be inaccurate or incomplete
  • You must independently verify any recommendations
  • You accept full responsibility for decisions based on AI outputs

4. Accounts

You are responsible for:

  • Maintaining account security
  • All activity under your account
  • Providing accurate information

We may suspend or terminate accounts that violate these Terms.

5. Subscriptions & Payments (Future)

Some features may require paid subscriptions in the future.

When enabled:

  • Subscriptions will be billed in advance
  • Pricing may change with notice
  • All payments are non-refundable unless required by law
  • Apple App Store / Google Play billing rules apply if purchased there

6. User Content

You may upload content (photos, data, messages, etc).

You retain ownership, but you grant Spur App LLC a worldwide, royalty-free license to use this content to operate and improve the Service.

You may not upload illegal, abusive, or harmful content.

7. Community Features (Future)

When community features are enabled:

  • You are responsible for your behavior
  • We are not responsible for user-generated content
  • We may remove content or ban users at our discretion

8. Wearables & Third-Party Integrations

Spur may integrate with Apple Health, wearables, or third-party services.

  • We are not responsible for third-party services
  • Data accuracy depends on those services
  • Use is at your own risk

9. Prohibited Use

You may not:

  • Reverse engineer or copy the software
  • Abuse or harass other users
  • Use Spur for unlawful purposes
  • Attempt to hack, scrape, or disrupt systems

10. Intellectual Property

All software, branding, designs, and content (excluding user content) are owned by Spur App LLC and protected by law.

11. Termination

We may suspend or terminate access at any time for violations or business reasons.

12. Disclaimer of Warranties

The Service is provided "AS IS" and "AS AVAILABLE."

We make no guarantees regarding:

  • Results
  • Accuracy
  • Availability
  • Fitness outcomes
  • AI outputs

13. Limitation of Liability

To the maximum extent permitted by law, Spur App LLC shall not be liable for:

  • Injuries
  • Health issues
  • Data loss
  • Lost profits
  • Any indirect or consequential damages

14. Governing Law

These Terms are governed by the laws of Texas, United States.
